Idaho Senate Bill 1354, signed into law on March 31, 2026 and effective July 1, 2026, limits how cities with populations above 5,000 may restrict accessory dwelling units. Under the new law, those cities may not impose an owner-occupancy requirement on an ADU or its primary dwelling, may not require off-street or guest parking for an ADU, and may not cap ADU size below 1,000 square feet or 75 percent of the size of the primary dwelling. The law also bars homeowners associations from adding, amending or enforcing covenants that prohibit ADUs unless the property owner agrees in writing.
For a builder that has worked the same nine-city footprint since 2001, the shift is practical rather than abstract.
“When I started in 2001, Star had a stoplight and a lot of farm ground,” said Alex Lobkov, owner of Comfort Expert Builders. “In twenty-five years I’ve mostly watched the rules around building get more complicated, not less. This one went the other way. A homeowner who got told no on a backyard unit three or four years ago has a real reason to ask the question again, because the answer may have changed.”

The company noted that the law’s protections apply to incorporated cities above the 5,000-resident threshold and do not extend to properties in unincorporated Ada or Canyon County, where local ordinances still govern. Homeowners are encouraged to confirm current requirements with their city before planning a build.
